In every family law matter it is important to balance the rights and interests of every party involved; especially children. As lawyers, our role is to inform our clients of their rights and obligations to ensure they reach the best outcome possible.
However the Family Law Act can have its limitations in balancing every party’s needs. This has recently become apparent as an Australian gay couple attempt to bring their child born by surrogate into Australia. The story raises interesting questions of what rights surrogates and caregivers of children should have. The law may soon need to address this as international births and surrogacies become increasingly common for homosexual couples.
